El Comité Municipal de Defensa de los Bienes Comunes y Públicos, ante el hecho criminal ocurrido contra los vecinos de Guapinol; Aly Domínguez y Jairo Bonilla, asesinados en la tarde del día sábado 07 de enero de 2023, manifiesta consternación, indignación y dolor, al mismo tiempo estamos presente para acompañar y hacer publica nuestra solidaridad con las familias Domínguez y Bonilla, y la comunidad.
1. La Comunidad de Guapinol en los últimos años ha sido brutalmente golpeada por la criminalización mediática, la judicialización y el encarcelamiento, hasta llegar al asesinato como lo evidencia el hecho criminal que ha segado la vida de Aly y Jairo, así otros vecinos de la comunidad han tenido este fatal desenlace en años anteriores. El luto y el dolor sacuden a la comunidad. Guapinol ha sufrido también el asedio policial y militar, estando detrás de esos actos la empresa minera Inversiones Los Pinares/Ecoteck que opera ilegalmente en la zona.
2. Hemos conocido a Guapinol como una comunidad en resistencia y con profundo amor a la vida, al agua, el ambiente, la paz. Nos ha enseñado a amar los bienes comunes. Allí conocimos a Aly Domínguez y Jairo Bonilla, jóvenes activos en las movilización, asambleas, conferencias, plantones, el campamento por el agua y la vida, eso habla de ellos como personas de bien. Aly Domínguez estuvo en la cárcel de Tamara junto a doce defensores más por acusaciones de Inversiones Los Pinares en un proceso judicial perverso y corrupto.
3. Teniendo conocimiento de este legado de amor y sacrificio de estos dos compañeros, hermanos, amigos, familiares, vecinos de Guapinol y este Municipio de Tocoa, es posible entonces recoger su ejemplo y levantar su amor como una antorcha que ilumine a la comunidad. En todo tiempo y en cualquier lugar y circunstancia, el amor es superior a la violencia. Sus familias ya no tendrán a un ser querido que abrazar, pero tendrán su amor y su entrega por lo bueno y justo que les animará y fortalecerá en la marcha. Seguramente ambos jóvenes, seguirán amando todo lo en vida amaron; la familia, el trabajo, el deporte, la lucha común, su río Guapinol, y su comunidad.
4. El Comité se une al clamor de justicia y exige al Ministerio Público (MP) una investigación oportuna, independiente y creíble para que el poder judicial deduzca las responsabilidades penales a los autores materiales del crimen. El Ministerio Publico ha actuado en contra de las y los defensores de derechos ambientales, arrastrado por el peso del gran capital y los tentáculos de Inversiones los Pinares, por tanto, tienen conocimiento de cómo se ha venido tramando el cuadro de riesgo y amenaza contra defensores del ambiente en Guapinol, Tocoa, sector San Pedro, entre otras comunidades. Ante este hecho criminal de alto impacto, al MP tiene los elementos para establecer sus conclusiones y demostrar técnicamente quienes son los autores materiales e intelectuales, en caso de existir.
5. Hasta ahora, el supuesto móvil del crimen fue un asalto con intención de robo según informe policial. Sin embargo, los criminales no se llevaron el dinero, éste fue entregado al propietario de la empresa para cual trabajaban los ahora occisos.
6. El Comité alerta a las comunidad nacional e internacional haciendo saber que hay personas defensoras de este colectivo señalados como posibles objetivos de exterminio. Las estructuras del crimen organizado siguen vigentes en el territorio, no pierden su naturaleza criminal y es posible que una investigación seria, responsable y objetiva arroje como resultado los vínculos entre estructuras del crimen organizado, empresas extractivas y funcionarios Públicos participando en ese frente criminal contra las personas y movimientos que luchan por la vida. Causales para pensar que eso puede suceder, existen. En los archivos del Mecanismo Nacional de Protección seguramente hay documentación de interés investigativa.
7. El fenómeno de la criminalidad en la región aumenta. Las estructuras criminales posiblemente están sacando sus colmillos para meter miedo en el pueblo y desestabilizar el país mediante el terror y los asesinatos. No se puede dudar que los grupos empresariales acostumbrados a imponerse por la fuerza bruta, construyen planes macabros contra quienes se oponen para hacer que fracase toda iniciativa de cambio en el país. La agroindustria, la minería e hidroenergía, han demostrado su perversidad criminal para apagar la lucha social por los derechos humanos utilizando diversos medios, tanto económicos, armados, mediáticos.
8. Esta situación de riesgo y amenaza contra la vida y los bienes comunes y públicos, obliga a todos los movimientos sociales y organizaciones defensoras de derechos humanos, a la unidad. La iniciativa del gobierno en su estrategia de combate a la criminalidad para garantizar la seguridad pública debe ser finamente construida con el actor popular.

Public Manifesto of the Municipal Committee
The Municipal Committee for the Defense of Common and Public Goods, before the criminal act occurred against the neighbors of Guapinol; Aly Domínguez and Jairo Bonilla, murdered in the afternoon of Saturday, January 07, 2023, expresses consternation, indignation and pain, at the same time we are present to accompany and make public our solidarity with the Domínguez and Bonilla families, and the community.
1. The community of Guapinol in recent years has been brutally beaten by criminalization by the media and through prosecution and imprisonment, up to the point of murder as evidenced by the criminal act that has taken the lives of Aly and Jairo, as well as other neighbors of the community have had this fatal outcome in previous years. Mourning and grief shake the community. Guapinol has also suffered police and military siege, being behind these acts the mining company Inversiones Los Pinares/Ecoteck operates illegally in the area.
2. We have known Guapinol as a community in resistance and with a deep love for life, water, the environment and peace. It has taught us to love the commons. There we met Aly Domínguez and Jairo Bonilla, young people active in mobilizations, assemblies, conferences, sit-ins, the camp for water and life, that speaks of them as good people. Aly Domínguez was in Tamara prison along with twelve other defenders for accusations made by Inversiones Los Pinares in a perverse and corrupt judicial process.
3. Knowing this legacy of love and sacrifice of these two companions, brothers, friends, relatives, neighbors of Guapinol and this Municipality of Tocoa, it is possible then to pick up their example and raise their love as a torch that illuminates the community. At all times and in all places and circumstances, love is superior to violence. Their families will no longer have a loved one to embrace, but they will have their love and their dedication to what is good and just that will encourage and strengthen them as they move forward. Surely both young men will continue to love everything they loved in life; family, work, sports, the common struggle, their Guapinol River, and their community.
4. The Committee joins the clamor for justice and demands the Public Prosecutor’s Office (MP) a timely, independent and credible investigation so that the judiciary can deduce the criminal responsibilities of the perpetrators of the crime. The Public Prosecutor’s Office has acted against environmental rights defenders, dragged by the weight of big capital and the tentacles of Inversiones Los Pinares, therefore, they have knowledge of how they have been plotting the risk and threats against environmental defenders in Guapinol, Tocoa, San Pedro sector, among other communities. In view of this high-impact criminal act, the MP has the elements to establish its conclusions and demonstrate technically who are the material and intellectual authors, in case they exist.
5. So far, the alleged motive of the crime was an assault with intent to rob according to police report. However, the criminals did not take the money, it was given to the owner of the company for which the deceased worked.
6. The Committee warns the national and international community that there are defenders of this group of people indicated as possible targets for extermination. The structures of organized crime are still in force in the territory, they do not lose their criminal nature and it is possible that a serious, responsible and objective investigation will show links between organized crime structures, extractive companies and public officials participating in this criminal front against people and movements that fight for life. There are reasons to believe that this could happen. In the archives of the National Protection Mechanism there is surely documentation of investigative interest.
7. The phenomenon of criminality in the region is increasing. The criminal structures are possibly baring their fangs to put fear in the people and destabilize the country through terror and assassinations. There can be no doubt that business groups accustomed to imposing themselves by brute force are building macabre plans against those who oppose them in order to make any initiative for change in the country fail. Agribusiness, mining and hydropower have demonstrated their criminal perversity to extinguish the social struggle for human rights using various means, both economic, armed and media.
8. This situation of risk and threat against life and common and public goods, obliges all social movements and human rights organizations to be united. The government’s initiative in its strategy to combat criminality in order to guarantee public security must be finely constructed with the popular actor.
